WavePark Booking Conditions
1.
Terms: WavePark Mentawai will hereinafter be referred to as the Company, which expression shall include its employees, agents, and sub-contractors. Any bookings of holidays (hereinafter referred to as Your Holiday) confirmed by the Company are subject to the entirety of this document. This document is a legally binding contract between the Company and the client wishing to book (hereinafter referred to as Yourself or You). A change to an existing booking is hereinafter referred to as an Amendment.

The Company is NOT a carrier or hotelier, nor do we own aircraft, hotels, or coaches. We exercise every care in the selection of reputable airlines, yacht, taxi, hotel and other suppliers of the various travel services, which are used in Your Holiday. It is important to note, that all the bookings with the Company are subject to the terms and conditions and limitations of liability imposed by airlines, charter yachts, and hoteliers. These service providers include but are not limited to shipping, car hire, yacht, taxi and restaurant operators, whose services we utilize, some of which limit or exclude liability in respect of death, personal injury, delay and loss or damage to personal belongings and baggage. WE REQUIRE THAT INSURANCE IS ARRANGED BY YOURSELF AGAINST THESE RISKS. The Company always does its best to make sure that Your Holiday arrangements are satisfactory and the Company accepts liability for any loss or damage sustained by You, but only to the extent and as a result of the Company’s negligence. However, the Company cannot accept any liability of whatever nature for the acts, omissions or default, whether negligent or otherwise of those airlines, shipping and taxi companies, hoteliers or other persons providing services in connection with Your Holiday. These services are defined pursuant to contract between themselves and You (which may be evidenced in writing by the issue of a ticket, voucher, coupon, or the like) and over whom the Company has no direct and exclusive control.

The Company does not accept any liability in contract or in tort for any injury, damage, loss, delay, additional expenses or inconvenience to You, caused directly or indirectly by force majeure or other events which are beyond the Company’s control, or which are not preventable by reasonable diligence on the Company’s part. These events include, but are not limited to war, civil disturbance, fire, floods, unusually severe weather, acts of God, acts of Government or of any authorities, accidents to or failure of machinery or equipment or industrial action (whether or not involving Company employees and even though such action may be settled by acceding to the demands of a labor group).

The Company will only confirm bookings and reservations of trips after the receipt of payment of the required deposit. The deposit for a trip will be accepted as part payment of the total cost of Your Holiday, but receipt of a deposit does not constitute acceptance of any booking, unless confirmed as accepted by the Company. The balance of the total trip cost is to be paid to the Company not later than 90 days prior to departure (or such later date as shall be specified in writing by the Company). Failure by Yourself to pay the said balance by the due date will entitle the Company to cancel all bookings made, whereupon the deposit paid by You shall be forfeited. The booking will then be open on a “first come, first served” basis to any guest who is willing to pay the total cost for the aforesaid booking. Late payments received 89-30 days prior to departure will incur a $100 late booking fee. Late payments received 29-15 days prior to departure will incur a $200 USD late booking fee. Late payments received 14-1 day(s) prior to departure will incur a $300 USD late booking fee.Any cancellation made by Yourself must be received in writing.

The following cancellation fees apply: (I) If the written cancellation is received by the Company not later than 90 days prior to departure the complete deposit is non-refundable and all other monies returned. (II) If the written cancellation is received by the Company on or within 90 days of the departure date the Company shall not be obliged to refund any monies whatsoever.

Tour costs are based on exchange rates and fuel prices (gasoline and diesel) current at the time of booking. The Company reserves the right to amend such prices prior to the departure of any tours should any fluctuations in currency, increases in fuel prices, increases in ground operator services or variation of group sizes occur which are outside of the exclusive control of the Company.

The Company shall not be liable in the event, due to climatic conditions that satisfactory surf is unavailable or that surf is of too great a magnitude for You to participate in such activities.
8.
Regarding ALL activities, particularly those of marine transport and surfing activities: You shall comply with the instructions of the Company’s representatives and guides at all times. You shall not remain on the tour while the status of your mental or physical condition is in the opinion of any representative, guide or employee of the Company, such as to render You incapable of caring for Yourself. The Company will not be responsible for expenses incurred by You failing to complete Your Holiday for this reason.
9.
Travel Insurance is mandatory to cover loss of deposit and cancellation fees and loss or delay of baggage, including surfboards or other sports equipment. The type of insurance purchased must include a provision for full medical expenses including a medivac option.
10.
The Company or its representatives and guides have the right to cancel or alter any itinerary without notice as may be found necessary to determine the suitability of climatic or other conditions for the normal performance of Your Holiday. Any additional personal expenses incurred, as a result of delay, including delay from mechanical breakdown will be the responsibility of the passenger. Refunds are not available for tours, boat transfers, accommodation or any other services not utilized during the course of a full or partially completed trip.
11.
Costs not included in Tour Price: Flights to and from Padang, West Sumatra; Excess baggage; Airport Porter fees; Personal spending money; Accommodation other than at WavePark Resort; Travel Insurance; Passport and/or visa costs, Mentawai surfer tax.
